Terms of Service

These terms are an agreement between you and Fair Raise LLC, an Arizona limited liability company ("Fair Raise", "we", "us"), covering your use of fairraise.org (the "Service"). By creating a fundraiser or making a donation, you agree to them. If you don't agree, please don't use the Service.

1. What Fair Raise is (and isn't)

Fair Raise is a platform that lets organizers create fundraising pages for schools, classrooms, PTAs, youth sports teams, clubs, bands and similar youth and community groups, and lets donors give to them. We are not a charity, a bank, or a party to any donation. Donations go directly to the organizer's payment account (see section 4); we never hold or control those funds. We don't verify how funds are ultimately used, and we're not responsible for an organizer's conduct or the outcome of any fundraiser.

2. Organizers

• You must be at least 18 and authorized to raise money for the school, team or group you name.
• Everything on your page must be truthful, and you must use the money for the purpose you describe.
• To receive donations you must connect a payment account with our payment processor, Stripe, and accept Stripe's Connected Account Agreement. Stripe may require identity and bank verification and may hold, delay or reverse payouts under its own terms.
• You are responsible for any tax, receipt and reporting obligations connected to the money you receive, and for telling donors accurately whether their gift is tax-deductible (see section 3).
• Your manage link is your password. Anyone with it can edit your fundraiser and see donor details. Keep it private; we're not responsible for access by someone you shared it with.
• You may close your fundraiser at any time. Donations already made are yours to handle, including any refunds.

3. Donors

• Donations are voluntary and are made to the organizer's connected account, not to Fair Raise.
• Tax deductibility depends on who receives the money — for example, a PTA that is a registered 501(c)(3) or a public school may be a qualified recipient; an individual teacher generally is not. Fair Raise does not issue tax receipts and makes no representation about deductibility. Ask the organizer, and consult a tax professional.
• Refunds are handled by the organizer through their Stripe account. Contact the organizer first; we can help you reach them but we cannot refund money we never held.
• Your name, message and amount appear publicly on the fundraiser's donor wall unless you choose to hide your name (section 6).

4. Payments and fees

• Payments are processed by Stripe. We never see or store card numbers. Stripe's privacy policy applies to information you give Stripe at checkout.
• Fair Raise charges a platform fee of 5% of each donation, collected automatically from the payment. Stripe charges the organizer's account its standard processing fee separately. A full example is on our fees section.
• At checkout, donors may choose to add an amount that covers both fees so the organizer receives the full donation. That option is on by default and can be turned off.
• If an organizer refunds a donation, the Fair Raise platform fee for that donation is refunded in the same proportion. Stripe's processing fee is not returned by Stripe on refunds and is not reimbursed by us.
• We may change the platform fee for future donations by updating the fees section; changes never apply to donations already made.

5. Things you may not do

You may not use the Service to:

• raise money for anything other than a genuine school, classroom, youth team, club or community-group purpose;
• misrepresent who you are, who benefits, or how funds will be used;
• do anything unlawful, fraudulent, harassing, discriminatory or infringing;
• post content you don't have the right to post, or that is obscene, threatening or hateful;
• send unsolicited bulk messages, scrape the Service, or interfere with its operation or security.

6. Content

You keep ownership of what you post (stories, messages, photos). You give us a non-exclusive, royalty-free license to host, display and share it as needed to run and promote the Service — for example, showing a fundraiser page or a donor message. Donors who choose "hide my name" have their name hidden from the public donor wall; the organizer can still see it. We may edit or remove content that violates these terms.

7. Our rights

We may pause, hide or remove a fundraiser, decline to provide the Service to anyone, or change or discontinue features at any time, including when we suspect fraud or a violation of these terms. Where practical we'll tell the organizer why.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We don't guarantee that any fundraiser will raise money, that the Service will be uninterrupted or error-free, or that any organizer will use funds as described.

9. Limitation of liability

To the fullest extent permitted by law, Fair Raise LLC and the people who run it are not liable for indirect, incidental, special, consequential or punitive damages, or for lost funds, donations or profits, arising from your use of the Service or the conduct of any organizer or donor. Our total liability to you for any claim is limited to the platform fees we received from donations to your fundraiser (or, for donors, from your donations) in the twelve months before the claim. Some jurisdictions don't allow certain limitations, so some of this may not apply to you.

10. Indemnity

If you're an organizer, you agree to defend and hold Fair Raise LLC harmless from claims arising from your fundraiser, your content, or your use of funds.

11. General

We may update these terms; the effective date above will change and material changes will be noted on this page. Continued use after a change means you accept it. These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. If any part is unenforceable, the rest stays in effect. These terms are the entire agreement between us about the Service.
